Terms of sale

The terms governing every order placed on this site. They apply to sales concluded with consumers.

1. Purpose and scope

These terms of sale govern sales of scarves, jewellery and gift sets offered by CARTHANET ("AVÉOR") on this site to private individuals.

CARTHANET, a French simplified joint-stock company with a single shareholder and share capital of 1,00 €, 930 115 506 R.C.S. Paris, registered office at 60 rue François Ier, 75008 Paris, France. Email: contact@aveorparis.com — telephone: 01 89 52 15 00.

Placing an order implies unreserved acceptance of these terms in the version in force on the day of the order. They are available on the site at all times and may be saved or printed.

2. The pieces

The essential characteristics of each piece — material, dimensions, colour, care — appear on its product page. Pieces are offered while stocks last.

If a piece turns out to be unavailable after an order is placed, we tell you without delay and refund that part of the order in full.

Some pieces are shown on the site before they can be bought. Their product page then states the month of their first shipment and does not allow an order to be placed. The alert offered on those pages — “Notify me” — is not a pre-order, a reservation or a commitment to buy on either side: it triggers one message when the piece goes on sale and, if it is still available and has not been ordered, a single reminder a few days later.

3. Prices

Prices are shown in euros including all taxes, with French VAT applied at the prevailing rate.

Shipping costs are shown before the order is confirmed and repeated in the summary. Shipping is free on orders over €80; below that, it is charged at €5.90.

Prices may change at any time. A piece is invoiced at the price in force when the order is confirmed.

When a reduction is announced, the struck-through price shown next to the reduced price is the reference price defined by article L112-1-1 of the French Consumer Code: the lowest price we applied to all our customers during the thirty days preceding the start of the reduction.

A promotional code applies to the subtotal, after that price. It cannot be combined with another offer unless stated otherwise, and its period of validity is given when it is issued.

4. Orders

An order has three steps: choosing the pieces, entering contact and delivery details, then paying. Confirming payment constitutes acceptance of the order and of these terms.

A confirmation email summarising the order is sent to the address given. The sale is complete only once that email has been sent.

The publisher reserves the right to refuse an order that appears abnormal, in particular where a previous payment dispute exists.

5. Payment

Payment is made online, in full, through our provider Stripe. Accepted payment methods are shown at checkout.

Card details are entered directly into Stripe's secure interface and never pass through our servers. They are neither collected nor stored by the publisher.

6. Delivery

Orders are prepared and dispatched within 48 working hours. Indicative delivery time is 2 to 5 working days after dispatch, within mainland France. In any event, and in accordance with article L216-1 of the French Consumer Code, delivery takes place no later than thirty days after the contract is concluded.

A tracking number is provided on dispatch and remains available in the customer account. If the deadline passes, you may require us to deliver within a further reasonable period and, failing that, cancel the sale and be refunded, under articles L216-1 et seq. of the French Consumer Code.

On arrival, check the condition of the parcel and, where appropriate, raise any reservation with the carrier.

Under article L216-4 of the French Consumer Code, the risk of loss of or damage to the pieces passes to you when you, or a third party you designate other than the carrier, take physical possession of them.

7. Right of withdrawal

Fourteen days to change your mind

You have 14 days from receipt of your order to withdraw, without giving any reason and without penalty.

Under articles L221-18 et seq. of the French Consumer Code, the right of withdrawal may be exercised by any unambiguous statement. A request can be made directly from the customer account, under “My orders”, or sent by email.

Pieces are to be returned complete, with their gift box, within 14 days of the declaration. Return postage is paid by the publisher. You may try a piece on as you would in a shop; if it has lost value through any other use, that loss of value may be deducted from the refund.

Refunds are issued no later than 14 days after you inform us of your decision. They may be withheld until the pieces have been received back or you have supplied proof of having sent them, whichever is earlier. They use the same payment method as the original order.

8. Legal guarantees

Every piece benefits from the statutory guarantees, independently of any commercial guarantee:

  • the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), allowing repair or replacement of a non-conforming piece for two years from delivery;
  • the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code), allowing cancellation of the sale or a price reduction for two years from discovery of the defect.

Under the legal guarantee of conformity, you do not have to prove the defect during the twenty-four months following delivery. These guarantees apply at no cost to you.

Your rights under the legal guarantees

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During that period, the consumer only has to establish that the lack of conformity exists, not when it appeared.

Where the contract of sale provides for digital content or a digital service to be supplied continuously for more than two years, the legal guarantee applies to that digital content or service throughout the planned supply period. During that period, the consumer only has to establish that the lack of conformity affecting the digital content or service exists, not when it appeared.

The legal guarantee of conformity obliges the professional, where applicable, to provide all updates needed to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a price reduction while keeping the goods, or end the contract and obtain a full refund against return of the goods, if:

1. the professional refuses to repair or replace the goods;

2. repair or replacement takes place after more than thirty days;

3. repair or replacement causes the consumer major inconvenience, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;

4. the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to end the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer is then not required to ask for repair or replacement first.

The consumer is not entitled to end the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee until the goods are returned in working order.

These rights arise from articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or to a full refund against return of the goods.

Any complaint may be sent to contact@aveorparis.com. We undertake to reply within 48 working hours.

Under articles L612-1 et seq. of the French Consumer Code, you may refer the matter free of charge to a consumer mediator if your written complaint has not been resolved within two months:

10. Personal data

The data collected when ordering is necessary to process that order. Its use, and the rights attached to it, are set out in the privacy policy.

11. Governing law

These terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts have jurisdiction under ordinary rules.

The French version of this document is the one that governs. This translation is provided for convenience; in case of divergence, the French text prevails.
